मिक्की मेहता मेमोरियल ट्रस्ट में हुए आर्थिक अनियमितता के मामले में निलंबित आईपीएस अधिकारी मुकेश गुप्ता के खिलाफ ईओडब्ल्यू ने एफआईआर दर्ज की है. आरोप है कि गुप्ता ने अपने प्रभाव का दुरूपयोग कर गरीब तबके को चिकित्सीय सुविधा दिलाने के ऐवज में सरकार से तीन करोड़ रूपए का अनुदान हासिल किया, लेकिन अनुदान राशि से बैंक का कर्ज पटा दिया. जांच में यह तथ्य भी ईओडब्ल्यू को मिले हैं कि नियम कानून को ताक पर रखकर चेरिटेबल ट्रस्ट का संचालन निजी लाभ के लिए किया जाता रहा. मानिक मेहता की शिकायत के बाद ईओडब्ल्यू ने अपने प्रारंभिक जांच में सामने आए तथ्यों के आधार पर निलंबित आईपीएस मुकेश गुप्ता, एमजीएम के मुख्य ट्रस्टी जयदेव गुप्ता और डायरेक्टर डा.दीपशिखा अग्रवाल के खिलाफ आईपीसी की धारा 420, 406, 120 (बी) तथा भ्रष्टाचार निवारण अधिनियम 1988 के तहत एफआईआर दर्ज किया है.
ईओडब्ल्यू के अधिकारियों के मुताबिक एमजीएम ट्रस्ट ने गरीबों के निशुल्क मोतियाबिंद आपरेशन कराने, शासकीय कर्मचारियों को विशिष्ठ चिकित्सा सुविधा का लाभ देने तथा मेडिकल स्टाॅफ को प्रशिक्षण देने के नाम पर साल 2006 में दो करोड़ और 2007 में एक करोड़ रूपए का अनुदान राज्य शासन से प्राप्त किया था. बाद में इस राशि का उपयोग बैंक का कर्ज पटाने के लिए कर दिया गया.
ईओडब्ल्यू के मुताबिक एमजीएम नेत्र संस्थान भवन को एसबीआई बैरन बाजार रायपुर में बंधक रखकर अस्पताल हेतु चिकित्सा उपकरण खरीदने के लिये 3 करोड़ रूपये का टर्म लोन तथा 10 लाख रूपये का कैश क्रेडिट लोन ट्रस्ट द्वारा लिया गया था. दिनांक 13.09.2004 को लोन लेने के उपरांत अल्प अवधि में अप्रैल 2005 में ट्रस्ट का लोन एकाउण्ट अनियमित हो गया.
ईओडब्ल्यू का कहना है कि लोन की प्रक्रिया में मुकेश गुप्ता आईपीएस का बिना किसी अधिकार के बैंक में हस्तक्षेप किया गया. बंधक भवन एमजीएम आई हास्पीटल का बैंक अधिकारियों को निरीक्षण कराया गया. बैंक के अभिलेख में मुकेश गुप्ता का नाम ट्रस्ट का मेन ड्राईविंग फोर्स एवं ट्रस्ट के संचालन के मुख्य कर्ता-धर्ता के रूप में उल्लेखित है. प्रभावशाली पुलिस अधिकारी शासकीय सेवा में रहते हुये मुकेश गुप्ता द्वारा ट्रस्ट का लोन एकाउण्ट अनियमित एवं एनपीए होने पर 13.09.2006 से कई बार बैंक के अधिकारियों को आश्वस्त कराते रहे कि, ट्रस्ट की आर्थिक स्थिति शीघ्र सुधर जाएगी एवं लोन एकाउण्ट नियमित होकर कर्ज अदायगी की जावेगी. बैंक को न तो समय पर लोन की राशि का ब्याज मिल पा रहा था और न ही लोन की किस्त अदा हो रही थी. बैंक अधिकारियों ने कहा कि- यदि दिसम्बर 2006 तक ऋण/व्याज की अदायगी प्रारंभ नहीं हुई तो ट्रस्ट के विरूद्ध वसूली की कार्यवाही प्रारंभ कर दी जाएगी. साल 2005-06 में जब मिकी मेमोरियल ट्रस्ट की माली हालत खस्ता थी, ट्रस्ट एनपीए के दौर से गुजर रहा था, उसी दौरान एमजीएम आई इंस्टीट्यूट की डायरेक्टर डॉ. दीपशिखा अग्रवाल के कंसलटेंसी फीस में अप्रत्याशित रूप से कई गुना वृद्धि हो रही थी. यह भी आश्चर्यजनक तथ्य है.
जांच में यह भी कहा गया है कि मुकेश गुप्ता ने बैंक अधिकारियों को अपने पद का प्रभाव दिखाकर ट्रस्ट की संपत्ति की कुर्की की कार्यवाही को रूकवाया और ट्रस्ट का कर्ज सेटलमेंट प्रकरण खारिज होने के बाद भी बैंक अधिकारियों से पुनः समझौता प्रकरण को प्रक्रिया में लाने का दबाव बनाया. कर्ज सेटलमेंट में बैंक को नुकसान हुआ और ट्रस्ट को 24 लाख रूपए का लाभ पहुंचाया गया.
ईओडब्ल्यू ने जांच में सामने आए तथ्यों के आधार पर बताया है कि जयदेव गुप्ता महज औपचारिक मात्र ही मुख्य ट्रस्टी थी, लेकिन इसके संचालन में मुकेश गुप्ता की महत्वपूर्ण भूमिका थी. ट्रस्ट के संचालन, भवन निर्माण समेत तमाम निर्णयों में मुकेश गुप्ता का प्रभाव होता था.
